The general terms and conditions of Clascon BV apply to all subsidiaries, trading names, directors, and employees – even if they are no longer active. The "client" is any party, business or private, to whom Clascon submits a quote or with whom it enters into an agreement.
Applicability
The general terms and conditions of Clascon apply to all its services, advice, offers, quotations and
agreements. This clarifies which agreements apply when Clascon carries out an assignment or provides services. Any purchasing or other conditions of the client only apply if Clascon has agreed to them in advance, without reservation.

Agreements and refusal
An agreement with Clascon is created as soon as we confirm your order in writing or start executing it. We

Collaboration with third parties
Sometimes we engage carefully selected third parties to carry out your assignment even better. Where possible

Fees and payment
Fee
When entering into the agreement, we clearly agree on how Clascon's fee will be paid. This could be incorporated into premiums or amounts, through a subscription, a fixed price, or an hourly rate. If, after the agreement is concluded, the costs for materials, services, or other necessary items increase, the rates can be adjusted accordingly. We will, of course, keep you informed of this.
Changes in taxes and levies
Any changes in taxes or levies imposed by the government will be passed on.
Payment term
We kindly request that you pay invoices within 14 days, unless otherwise agreed. Paying on time is important, as otherwise your insurance coverage may be jeopardized. We charge a small fee for reminders.
Settlement
If you have a counterclaim, we can discuss it and only offset it if we have confirmed this in writing or if it has been legally established.
Statutory interest
In case of late payment, we charge statutory interest. If payment is not received after a reminder, collection costs may be charged at the applicable rate. Upon payment, we first settle outstanding interest and costs, followed by the oldest invoices.
Creditworthiness
If we have doubts about your creditworthiness, we may ask for additional security before continuing to provide services.
Deadlines
The terms stated by Clascon are as realistic as possible, but are not hard deadlines, unless we make other written agreements about this.
Cooperation by the client
Relevant information
The client always provides Clascon, whether requested or not, with all information necessary for the proper execution of the assignment. If information is missing, provided too late, or if the client fails to comply with their information obligations, Clascon may suspend execution.
Accuracy and completeness
The client is responsible for the accuracy and completeness of all information provided.
Liability Clascon
Limitation of the amount of liability
At Clascon, we do everything we can to carry out our work with care. Should anything go wrong, our liability—including that of our directors, employees, and any specialists we engage—is limited to the amount paid out under our professional liability insurance, plus the deductible. We'd be happy to provide you with more information if you'd like.
Other restrictions
If the insurance does not provide cover, the liability will be limited to a maximum of the fee or premium charged for the assignment in question.
Only for our client
Our work is always intended for you, the client. Third parties cannot derive any rights from this.
Accurate and timely information
We trust that you will provide us with accurate and complete information in a timely manner. If this information is missing or arrives too late, we cannot be held responsible for any damages.
Use of software
We work with reliable software, but are not liable for damage caused by errors in it, unless we can recover these damages from the supplier.
E-mail traffic
We cannot accept any responsibility for damages if sent emails do not reach us.
Premium payments
If you fail to pay your insurance or benefits premiums or pay them too late, this may affect your coverage. Any resulting damages are not our responsibility.
Payment obligations upon termination
An agreement can only be terminated if Clascon, after a clear reminder, fails to fulfill its obligations. Any outstanding amounts remain due in that case.
Force majeur
Clascon makes every effort to honor agreements. Sometimes circumstances beyond our control, such as problems
Suppliers, government measures, or unexpected events may affect implementation. In such cases, Clascon is not responsible for any delays or shortcomings, as it is simply not possible to act otherwise. We will, of course, always keep you informed if such a situation arises.
Confidentiality and protection of personal data
Confidentiality
We value your privacy. Therefore, we agree to treat all information we receive from our collaboration confidentially. We assume that both parties understand which data is confidential and
handle this with care.
Sharing personal data
Sometimes it is necessary for Clascon to share your personal data with carefully selected third parties, for example to properly execute your financial or insurance agreement, to handle a claim or to comply with legal requirements.
Obligations. These third parties may only use your data for the agreed-upon purpose, and we document this in clear, written agreements.
Objection to the use of personal data
Do you object to your information being included in our mailing lists? Please let us know, and we will remove your information from the relevant database upon your first written request.
Applicable law and disputes
Applicable law
Dutch law applies to all Clascon offers, quotes, and agreements. This ensures clear and reliable agreements.
Financial Services Complaints Institute
Clascon is affiliated with the Financial Services Complaints Institute (Kifid). Should a dispute arise from our collaboration, you can submit it to the Financial Services Disputes Committee or the civil court. This way, you always have an independent opportunity to discuss your complaint.
Expiration of rights
We believe it is important that you know exactly where you stand. Therefore, all claims and other rights you have against Clascon will expire no later than five years after you became aware of these rights or
could reasonably have been.
